Of course you would like to know the terms and conditions under which you purchase services or products from Jong Piano Talent. Don't worry: it's quite a bit of reading, but we've kept it as easy as possible. Are you an expert in reading laws? If so, they are referenced here and there. These terms and conditions assume a win-win situation; it is based on the idea of "taking care of" each other. Below you can read under which conditions Jong Piano Talent offers its services. Under the heading article we understand in this case the rules and conditions by which Jong Piano Talent offers its services. 

If certain conditions and rules are not clear, please do not hesitate to ask me your questions.

1. Definitions

In these general terms and conditions and the agreements to which they have been declared declared applicable, the following terms shall have the following meanings: 

Aanbieder:  JONG PIANO TALENT, gevestigd te Almere en ingeschreven bij het handelsregister van de Kamer van Koophandel onder nummer 74492012 vertegenwoordigd door Mkhitar Ghazaryan;

Afnemer: leerling of een organisatie die een dienst of product van aanbieder wenst af te nemen;

Overeenkomst: de overeenkomst voor de levering van diensten of koop van producten tussen aanbieder en afnemer en alle verdere handelingen tussen aanbieder en afnemer betreffende de verkoop en levering van diensten of producten, inclusief aanbiedingen en aanmeld procedures en inclusief de op overeenkomsten toepasselijke algemene voorwaarden; 

Producten/diensten: de door aanbieder aan afnemer al dan niet online te verkopen en te leveren of verkochte en geleverde producten;

2. General matters and practices 

• You can choose between 1, 4 or both (1 + 4) individual trial classes and then decide if you want to continue with our regular classes. 
• The (half) year track consists of 19 lessons and the year track consists of 38 individual lessons per school year (once a week). 
• If you choose half year course and go for monthly payments then you will pay 6 months of 6 x the monthly amount of your package.
• If you go for quarterly payments then you pay the quarterly amount of your package once every 3 months (so 2 times in total).
• If your choice was to pay tuition in one lump sum then you will pay 1 x for 6 months (for 19 classes). 
• The lessons or the (half-)year course are not finalized until payment has been received upon reservation.
• Failure to pay will automatically cancel the appointment. 
• Class time is 20, 30, 45 or 60 minutes.
• Voor sommige leerlingen is het mogelijk om losse lessen te boeken. Dit gaat dan vaak met een strippenkaart. 
• Een strippenkaart van 5 lessen dient binnen 2 maanden opgemaakt te worden en een strippenkaart van 10 lessen binnen 5 maanden. 
• Subscriptions are renewed automatically. You have a notice period of 1 month (written notice via whatsapp, email or text message). 
• Normaliter doen we 1 keer per schooljaar een inflatiecorrectie. 
• We houden vooraf gemaakte afspraken zoveel mogelijk hetzelfde maar hou rekening mee dat inflatiecorrectie invloed kan hebben op lestarieven van doorlopende abonnementen. 
• Wil je inflatiecorrectie voorkomen? Betaal het collegegeld in een keer voor half of een jaar en voorkom extra kosten bij inflatiecorrectie. 
• Stop je na inflatiecorrectie met de lessen bij ons dan betaal je alleen voor alle gemiste lessen.
• Daarna kan je zonder verplichtingen stoppen met de lessen. 

3. Betalingen, het abonnement en lestarieven 

• Door inflatie en gestegen kosten zijn onze uitgaven de afgelopen jaren flink gestegen. 
• Tegelijkertijd is ook de niveau van de lessen en verschillende skills die we bij ons aanbieden steeds naar een hoger niveau gegaan. 
• Hierdoor kan je naast piano leren spelen bij ons nog meer waardevolle en toffe skills tegelijkertijd leren waarmee je je dromen nog sneller kunt waar maken! 
• We blijven non-stop investeren in onze skills omdat we belangrijk vinden om onze lessen en skills ge-update te houden en nog belangrijker verder ontwikkelen, zodat we onze leerlingen de beste onderwijs kunnen aanbieden. 
• Bij ons is het het goedkoopste om het collegegeld in een keer of per kwartaal te betalen want dan betaal je namelijk hetzelfde tarief. 
• At the beginning of the lesson, the lesson is checked as having been or not been. 
• Kies hoe je wil betalen (bijvoorbeeld met cash/contant of elektronisch). 
• Let op: voor alle betalingen zowel cash en elektronisch betaal je een toeslag van 10% (in de prijzen op tarieven pagina inbegrepen).

• Sommige abonnementen bijvoorbeeld maand, kwartaal, halfjaar en jaar kunnen in de vakanties doorlopen. 
• Vanaf de ingang van je contract tot je contract klaar is krijg je of 19 als je keuze voor halfjaar gaat of 38 lessen. 
• Je betaald nooit te veel. 
• Voor boekingen in het weekend betaal je een hoger tarief. 
• Alle uitgelopen lessen tot maximaal 5 minuten zijn kosteloos. Na 5 minuten niet meer. 
• You always have one month's notice so our advice is to put the notice date in your calendar so you don't forget. 
• Without cancellation, your subscription will automatically renew. 
• Ga je door met de lessen na je eerste contract dan krijg je als vaste klant 10% korting bij je volgende contracten. 

4. Quitting early/not keeping appointments  

• In the trial lesson or trial period, we work with our students to find out if piano lessons with us are really for them.
• After the trial lesson or trial period, a (half-)year program will be concluded if student decides to continue piano lessons and if there is a good match from both sides. 
• The trial period is a maximum of 5 lessons. If you continue after that, you cannot cancel after that until your course is finished. If the agreement is cancelled halfway through the year or trajectory by the client, an administration fee will be charged. 
• For one-year or half-year courses €257. 
• If the student or his/her legal representative remains in default by failing to make payment due, Jong Piano Talent will proceed with collection.
• Onze partners vanuit incasso en deurwaarder bureau nemen het in dat geval van ons over als de facturen niet of niet op tijd betaald worden na contact met klant. 
• Let op: de kosten met betrekking tot die invordering komen, naast het reeds verschuldigde bedrag, voor rekening van de cursist/afnemer. 
• In addition to the principal sum, these costs also consist of statutory (commercial) interest, extrajudicial collection costs and other damages payable by Jong Piano Talent. 
• Collection costs are calculated according to the Decree on Compensation for Extrajudicial Collection Costs. 
• Is er geen klik vanuit onze kant met een cursist of zijn/haar vertegenwoordigers omdat het contact niet fijn verloopt dan zullen we de afgesloten overeenkomst of de afspraken die zijn gemaakt per direct beëindigen. 
• In zo een geval houden we alleen het bedrag in van alle gemiste lessen voor correctie en kan de afnemer zonder verplichtingen stoppen met de lessen.  

5. Canceling and making up lessons 

• A class can be cancelled free of charge within 24 hours. 
• Let op: is je les buiten 24 uur afzegging beleid afgezegd, dan wordt de les als voltooid aangemerkt. 
• We begrijpen dat je op het laatste moment voor de les ziek kan worden.
• We kijken dan per situatie wat het beste is om te doen maar hou er rekening mee dat de helft van de gemiste les in rekening gebracht kan worden.
• Ben je vaak ziek? We begrijpen dat dat ook kan gebeuren maar dan kan je bij ons tijdelijk geen lessen volgen tot je weer beter wordt.
• We zetten je contract dan tijdelijk stop. 
• Ben je verkouden, heb je korts, hoest je heel erg of heb je corona gerelateerde verkoudheidsklachten of een besmettelijke ziekte? Blijf dan thuis. 
• Als je wenst de fysieke les wordt dan omgezet naar een online les indien je beschikt over een eigen piano, een computer of een smartphone. 
• Lessons not taken within (half-)year courses will automatically expire at the end of the current school year (the contract). 
• Until the course is finished from the start of the contract, students must complete all the lessons in the contract within that time frame. 
• We advise our students and parents to attend weekly for regular classes as our schedule is often fully booked. 
• Are two or more of your children from the same family taking piano lessons at Jong Piano Talent and one of the children is unable to attend? Then it is possible for a sibling to take over the lesson. 

6. Grants 

• If you are from Almere, or another municipality and fall below a certain income limit, in many cases a subsidy application for your child is possible. For more information, see the link below in case you live in Almere, or check your own municipality's website for more information: https://jeugdfondssportencultuur.nl/fondsen/almere/
• Students and professionals can apply for a maximum of 2000 euros subsidy each year from Werktuig PPO through https://werktuigppo.nl/ . This way it is possible to get 1/3 of the total costs reimbursed. 

7. Online piano lessons 

• Young Piano Talent offers online piano lessons in addition to in-person piano lessons at its own lesson location. Learn more at https://jongpianotalent.nl/pianoles-online/.
• It is up to the student to indicate how they wish to take the classes.
• In case of restrictions such as lockdown, visitation restrictions or day-night curfew, classes will be held online.

8. House rules and piano lessons 

• Come to our class location alone or with a maximum of one companion. 
• Kom rustig kamer G08 binnen indien de voordeur van het gebouw en de studio open is en ga lekker zitten. 
• Is the door locked, wait to be called in. 
• De lessen starten stipt op de afgesproken tijd.
• We willen daarom onze cursisten en ouders/begeleiders vriendelijk vragen om precies op de afgesproken tijdstip te komen.
• Ook omdat de hoofdingang van het gebouw voor veiligheidsmaatregelen tijdelijk gesloten blijft. 
• 1 tot max 3 minuten voor je lestijd op locatie aanwezig zijn is prima (niet veel eerder bijvoorbeeld 10 of 15 minuten).
• Young Piano Talent is open by appointment only. 
• Betaal en bevestig je afspraak gemakkelijk en veilig via Strpe met je creditcard of via de tarieven pagina van onze website via de betalingslink na je boeking. 
• Let op: je afspraak is pas definitief en door je gereserveerde tijd is pas beschikbaar nadat je de betaling direct hebt voldaan.
• Doe je dit niet dan wordt je afspraak automatisch geannuleerd door ons boeking systeem.
• Kom je toch naar ons muziekstudio omdat je onze werkwijze niet kent en de algemene voorwaarden van JPT niet hebt gelezen en de annulering niet hebt gezien dan kan het zijn dat we in de studio niet zijn of er wel zijn maar niet in de gelegenheid zijn om je dan les te geven.
• Voor het geval dat we wel in de studio zijn en beschikbaar zijn om je les te geven moet je aan de deur alsnog de betaling van de les voldoen.
• Uiteraard als je de proefles dan wil volgen.
• We daarom je vriendelijk om voor je komst een afspraak te maken via het aanmeldformulier of onze boeking platform. 

9. Complaint 

• If you have questions or a complaint about an invoice and/or the services and products provided please contact Jong Piano Talent in writing via our email or whatsapp as soon as possible, but no later than 5 business days after the complaint arises.
• In this case, Jong Piano Talent will handle the complaint within 7 calendar days. Filing a complaint does not suspend the payment obligation. 
• Have you received an incorrect invoice from us or is there an unexpected error in the invoice? Please contact us first before proceeding with a chargeback. 
• In case of a chargeback without consultation, JPT will deduct 25 for administrative costs from the refund. 

10. Damage to JPT's studio equipment and noise pollution during classes outside the classroom 

• Bij schade aan apparatuur of muziekstudio door onvoorzichtig gebruik krijg je als cursist of ouder eerst een waarschuwing en een advies hoe je wel goed om kunt gaan met studioapparatuur en muziekinstrumenten. 
• Let op bij grove schades betaal je altijd voor de reparaties of voor het apparatuur. 
• We vinden het prettig als er in de lesruimte een fijne sfeer hangt en dat er geen geluidsoverlast is buiten de lesstof zo kunnen we maximaal gefocust zijn op de les. 
• Er is in de les uiteraard ruimte voor humor, plezier en een kort gesprekje buiten de lesstof.  

11. Dispute resolution 

• A dispute exists if course participant or Young Piano Talent so states.
• Wij doen er beiden alles aan dat het nooit tot een geschil komt maar mocht dit onverhoopt gebeuren, dan zullen wij ons eerst tot het uiterste inspannen een geschil in onderling overleg op te lossen.
• Als dit niet lukt dan kan er in tweede instantie een beroep worden gedaan op de rechter.
• The court in the district of Jong Piano Talent's place of business has exclusive jurisdiction to hear disputes. Unless otherwise required by law. 
• Young Piano Talent reserves the right to submit a dispute to another judge. 
• The agreement is exclusively governed by Dutch law.

12. Privacy and confidentiality

• We are both obliged to maintain confidentiality of everything discussed during or in the context of the execution of the assignment. This duty of confidentiality remains in force even after termination of the agreement. 
• Information is considered confidential if it is communicated by JPT or you, or if it arises from the nature of the information.
• The duty of confidentiality does not apply if: JPT is required to disclose under the law or a binding ruling by a court or government body, and if JPT is acting for itself in a legal proceeding in which such information may be relevant.
• When using the Services, personal data are processed by JPT on behalf of Client. You are responsible for informing Users about this processing of personal data and guarantee that there is a legal basis for the instruction given to JPT to process (personal) data. 
• JPT is not responsible if customer has not informed users about the processing of personal data or has informed them in an incorrect manner. 
• Because JPT processes personal data on your behalf in the performance of the agreement, it is subject to the agreements set forth in these general terms and conditions.
• Ben je voor het eerst en wil je foto's of videos maken van de les van je kind of een opnamen en een foto voor jezelf? We begrijpen dat je graag beeldmateriaal wil maken voor eigen gebruik of omdat je het leuk vind.
• Helaas werkt dit voor het leer proces van sommige pas beginnende kinderen niet goed. Hiernaast zouden we het fijn vinden als je eerst toestemming vraagt voor het maken van beeldmateriaal. Alvast dank voor je medewerking! 
• Onze lesstudio en de gang (de wachtruimte) wordt 24/7 gefilmd (video en audio) voor veiligheidsredenen.
• We vragen je begrip en vertrouwen in de beslissingen die wij nemen.  

13. Copyright

• De inhoud van deze algemene voorwaarden en de informatie op de website van JPT, inclusief teksten, blogs, afbeeldingen, video's, logo's en alles wat uniek is aan ons merk en ontwikkeld is door JPT zoals (les)materialen en methodes (inclusief ons huisgemaakte eigen piano methode) is de creatieve eigendom van Jong Piano Talent. 
• De eigendomsrechten van Innovative Piano Method lesboek 1, 2, 3 en 4 plus aanvullende opdrachten die daarbij horen is opgeslagen in iDEPOT bij BOIP als bewijs voor eigendomsrechten van de schrijver (Mkhitar Ghazaryan). 
• It is not allowed to reproduce, distribute, copy and publish similar ideas on the market or on any other platform, book, website, article or in a blog or in any way without the prior written permission of Young Piano Talent. 
• Violation of this prohibition can lead to criminal prosecution and claims for damages. For infringement, the court may be able to impose a large fine and prison sentence if it is found that copyright infringement has occurred. 
• JPT can go to court to defend itself against infringement. 
• Exceptions: In some cases, Young Piano Talent may grant permission to third parties to use lesson materials, provided this is in writing and the terms are agreed upon. 

15. JPT teaching materials and events. 

• Learning packages do not include learning materials and event (family) tickets. 
• At the start of your classes or in between, you will need to purchase class materials for the classes. 
• You do that sometimes with us and sometimes via designated link via the Internet on advice. 
• For workshops, master classes and other events, you must purchase a family ticket or a single ticket. 
• We nemen de helft van de kosten op onze rekening om optreden in mooie zalen mogelijk te kunnen maken.

(Amendment) general terms and conditions 16.

• Young Piano Talent may amend, modify or supplement these terms and conditions at any time and without prior notice. The modified conditions will then apply to all legal relations with the student. 
• Heb je na aanleiding van de wijziging van onze algemene voorwaarden of prijs aanpassingen vragen? Neem dan binnen 7 dagen nadat we je hebben laten weten over de veranderingen contact met ons op.
• Doe je dit niet dan ga je stilsgewijz met de voorwaarden van de gewijzigde algemene voorwaarden.
